There is limited space for this programme and we want to make sure you are INVESTED. We are 110% devoted to you and your growth, so this will only work if you are 110% devoted to yourself also.
By placing your Order with Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe, by clicking “accept/purchase/pay now,” or by using the Services, you agree to be bound by this Agreement:
PAYMENT POLICY. You acknowledge that there are no refunds, all sales and payments are final. For paid-in-full purchases, full payment for the programme is collected at the time of purchase. For split payment plan purchases, the first installment is auto drafted at the time of purchase and the second installment is auto drafted 30 days later (for example, first installment is auto drafted at time of purchase on January 1 and second installment is auto drafted on February 1).
Payment is required before beginning the program either in full or in partial installments as outlined in the above paragraph. You agree to pay the amount agreed and not to cancel this transaction with your bank or Credit Card Company. Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe is not responsible for any overdraft charges, over limit charges, or NSF fees charged by your bank or Credit Card Company. Fees or Services may be prepaid or by installment as outlined above. Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe does not make any representations or warranties as to specific outcomes or results.
If we are unable to charge your card for a monthly installment, you will receive an email notification of this failed payment to the email listed through Kajabi at the time of enrollment. It is your responsibility to resolve this by updating your credit card info on file with Kajabi or emailing us at [email protected]. As you may be enrolled in a subscription, our payment system will attempt to collect this failed payment automatically, multiple times until successful. Failure to collect this payment will result in an involuntary cancellation, please see cancellation terms below. If we are able to collect the failed payment after our attempts, your account will be up to date and no further action is required.
CANCELLATIONS. All cancellations are subject to a $200 cancellation fee. Involuntary cancellation occurs if we cannot collect the failed payment after numerous automatic attempts (see above). Your membership will be cancelled immediately and marked as ‘uncollectible’. Any accounts that are marked as ‘uncollectible’ are subject to additional fees and may be sent to collections.
Please note, if a cancellation takes place you will no longer be eligible for a payment plan for any future The Embodied Babe memberships/subscriptions/programmes/offers. Your account will be marked as ‘delinquent 'and all future memberships/subscriptions/programmes/offers will be required to be paid-in-full, at the time of purchase. Additionally, you will be removed from any social media/groups immediately and your Kajabi portal access will be revoked.
YOU EXPRESSLY AGREE THAT YOUR USE OR INABILITY TO USE ANY OF THE SERVICES IS AT YOUR SOLE RISK. By purchasing the Services, you accept, agree and understand that you are fully responsible for your progress and results from your participation and that we offer no representations, warranties or guarantees verbally or in writing regarding your earnings, business profit, marketing performance, audience growth or results of any kind. You alone are responsible for your actions and results in life and business which are dependent on personal factors including but not necessarily limited to your skill, knowledge, ability, dedication, business savvy, network and financial situation, to name just a few. You also understand that any testimonials or endorsements by our customers or audience represented on our programs, websites, content, landing pages, sales pages or offerings have not been scientifically evaluated by us and the results experienced by individuals may vary significantly. Any statements outlined on our websites, programs, content and offerings are simply our opinion and thus are not guarantees or promises of actual performance. We offer no professional legal, medical, psychological or financial advice.
CONSTRUCTION. This Agreement shall be construed fairly and not interpreted for or against either party.
INTELLECTUAL PROPERTY. All materials and coaching provided to you as part of Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe which are the subject of this Agreement are proprietary and may not be duplicated, copied, reproduced, published or displayed in any form without the prior express written permission Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe. You may not re-use, perform, modify, broadcast, transmit, re-post or use in any way the content or any derivative works thereof, without the prior express written permission of Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe. All trademarks, logos, and service marks displayed on any materials provided as part of Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe under this Agreement are protected by US and International copyright and intellectual Property laws. Access to any materials or content online or otherwise as part of Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe are subject to this Agreement should not be construed as granting any license or right to use said content, including trademarks, logos and service marks of Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe.
ENTIRE AGREEMENT. This Agreement represents the entire understanding relating to the Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe, and any and all prior agreements, understandings, and representations, whether express or implied, written or oral, regarding Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe, are of no further force and effect. In order to participate in Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe, you may be notified that you may be required to agree to additional terms and conditions as the Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe is revised over time. You may receive a copy of this Agreement at any time by emailing Bianca Taylor Fitness Enterprises Inc. and The Embodied Babe ([email protected]) and requesting a copy of your “Program Terms of Purchase”.
